Waste shipments

COMMUNICATION FROM the european union

The following communication, dated 13 May 2024, is being circulated at the request of the Delegation of the European Union.

1._    The EU would like to inform the Members of the Committee on Trade and Environment that on 11 April 2024 the EU adopted Regulation (EU) 2024/1157 of the European Parliament and of the Council of 11 April 2024 on shipments of waste, amending Regulations (EU) No 1257/2013 and (EU) 2020/1056 and repealing Regulation (EC) No 1013/2006 (hereafter, the Waste Shipment Regulation). The Waste Shipment Regulation was published in the Official Journal of the European Union on 30 April 2024.

2._    The Waste Shipment Regulation aims to ensure that the EU:

a._    does not export its waste challenges to third countries and contributes to the environmentally sound management of waste;

b._    strengthens enforcement to prevent illegal shipments of waste occurring within the EU, as well as from the EU to third countries;

c._     increases the traceability of shipments of waste within the EU; and

d._    facilitates recycling and reuse.

3._    The Waste Shipment Regulation sets out the obligations that exporters shipping EU waste to third countries must comply with.

4._    Building on the Basel Convention and the Organisation for Economic Co-operation and Development (OECD) Decision of the Council on the Control of Transboundary Movements of Wastes Destined for Recovery Operations, the Regulation features different regimes for OECD and non-OECD countries. The European Commission will reach out to non-OECD countries in the coming months to provide them with detailed information about the rules that will be applicable to them.

5._    The Regulation will enter into force on 20 May 2024, and it will start to apply from 21 May 2026, except for:

a._    Articles 2(2) point (i), Articles 7(10), 11(5), 14(3), 15(6), 18(15), 27(2) and (5), 29(3) and (6), Article 31, 41 to 43, Article 45, 51(7), 61(7), Article 66, Articles 79 to 82 and Article 83, points 1 to 3, from 20 May 2024;

b._    Article 39 point (1)(d) from 21 November 2026;

c._     Articles 38(2) point (b), Article 40, Article 44(2) point (a), and Articles 46 and 47 from 21 May 2027, except for Article 40(3)(b) which shall apply from 21 May 2026;

d._    Article 73 from 1 January 2026.

6._    The transition periods will allow third countries and stakeholders to get acquainted with the new rules and take the necessary steps.
