The following communication, dated 16 April 2004, from the Delegation of the United States is being circulated to the Parties to the Agreement on Government Procurement.

On 19 March 2004, the Secretariat circulated the Republic of Korea’s Proposed Modification to its Appendix I (GPA/MOD/KOR/1), in which Korea proposed to withdraw the Kookmin Bank from Annex 3 of Appendix I of the Agreement on Government Procurement.
The United States requires additional time to study and to seek clarification from Korea in order to determine whether, pursuant to Article XXIV:6(b), "government control or influence" over Kookmin Bank has been effectively elimi
