OF THE RESULTS OF THE CONSULTATIONS UNDER ARTICLE 12.3

The following communication, dated "October 2024" and received on 8 January 2025, is being circulated at the request of the delegation of India.

Pursuant to Article 12.5 of the WTO Agreement on Safeguards (Safeguards Agreement), India is notifying the result of the consultations conducted with Indonesia under Article 12.3 of the Safeguards Agreement. Document _G/SG/N/8/IDN/31-G/SG/N/10/IDN/31 (dated 16 September 2024) contains a notification from Indonesia concerning measures taken under the Safeguards Agreement concerning Slag Wool and Rock Wool.

On 7 October 2024, India and Indonesia conducted consultations to discuss the information provided in the above-mentioned document dated 16 September 2024. India and Indonesia discussed the relevant information and exchanged views on the safeguard measures on Slag Wool and Rock Wool.

India submitted a written list of inquiries such as regarding the employment growth during the period 2020-23, despite a decline in production trends; lack of diversification and low productivity within the domestic industry as probable reasons for the lack of competitiveness than the increase in imports; clarification on the duration of each period and the anticipated percentage of the specific duty to be imposed, and information on adequate trade compensation mechanisms to mitigate the adverse effects of the measures. Indonesia's reply to the inquiries was not satisfactory. Thus, the consultations remained inconclusive.

Accordingly, India reserves its right to request compensation pursuant to Article 8 paragraph 1 of the Agreement on Safeguards.
