OF THE RESULTS OF THE CONSULTATIONS UNDER ARTICLE 12.3
COMMUNICATION

Ceramic flags and paving, hearth or wall tiles
The
following communication, dated and received on 1 October 2024, is being
circulated at the request of the delegation of India.

Pursuant
to Article 12.5 of the WTO Agreement on Safeguards (Safeguards Agreement),
India is notifying the results of the consultations conducted under Article
12.3 of the Safeguards Agreement. Documents _G/SG/N/8/IDN/20/Suppl.2 (dated 12 August 2024) and _G/SG/N/8/IDN/20/Suppl.2/Corr.1 (dated 22 August 2024),contain notifications
from the Indonesia concerning measures taken under the Safeguards Agreement
concerning Ceramic flags and paving, hearth or wall tiles.
On
29 August 2024, Indonesia and India conducted consultations with a view to
discuss the information provided in the above-mentioned documents dated 12
August 2024 and 22 August 2024 related to the safeguard measure on Ceramic
flags and paving, hearth or wall tiles. Indonesia and India discussed the
relevant information and exchanged views on the measure. India submitted a
written inquiry to Indonesia seeking clarification on specific aspects of the
notification. These inquiries included questions about causal relationships,
additional factors, apparent contradictions, unforeseen developments, the
impact on employment and profits, industry adjustment, the rationale for
seeking two-year extension, efforts made so far under Structural Adjustment
Program, and the proposed exclusion of certain products from the safeguard
measure. Indonesia subsequently provided written responses to these inquiries.
The result of the consultations was
inconclusive. Accordingly, India reserves its right to request compensation
pursuant to Article 8 paragraph 1 of the Agreement on Safeguards.
