description of the notified legal text _The notified
legal text is the Design Protection Act incorporating the amendments
contained in the Act on Partial Amendment to the Design Protection Act (Act
No. 19710, Promulgated on 14 September 2023). These amendments aim to
improve and supplement shortcomings in the current design trial system. The
main changes are as follows: 1.
They allow the presiding judge to
make corrections ex officio
when the matters for amendment in a trial request are obvious and
insignificant. 2.
They permit the presiding judge, when
deemed necessary for the sake of case hearing, to request public
organizations and other witnesses to submit written opinions. 3.
They allow state agencies and local
governments to submit written opinions to the Intellectual Property Trial and
Appeal Board on the matters related to the public interest. |
