Brief

The Intellectual
Property Act 2011 ("Act") of Samoa provides protection for
intellectual property rights in Samoa over registered trademarks, patents,
innovation patents, plant breeder's rights, design rights, registered
designs, geographical indications and lay-out designs of integrated circuits.
The
Act Repeals the following Acts:
• Patent Act 1972
• Trade Marks Act 1972
• Industrial Designs Act 1972
The
Act Amends:
• Sections 306, 307 and 314 of the Customs
Act 2014
The

Samoa's intellectual property framework with international standards.
Notably, the 2017 amendment updated fee provisions; the 2018 amendment
introduced the Madrid Protocol, facilitating the international registration
of trademarks; and the 2020 amendment incorporated the Patent Cooperation
Treaty, the Geneva Act, and the Hague Agreement, thereby enabling the international
registration of patents, industrial designs, and geographical indications.
