Brief description of the notified legal text

 

This amendment to the Korean Customs Act strengthens the border enforcement of intellectual property rights (IPR) for goods imported via postal services.

 

The revision of Article 235, Paragraph 3 expands the conditions for notifying IPR holders of suspected infringements. Previously triggered only by the filing of an import declaration, the notification can now also be made when "the relevant goods arrive at a customs clearance post office". A new Subparagraph 6 ("goods arriving at a customs clearance post office") has been added to the same paragraph to clarify this. This change addresses a procedural gap and allows for more timely intervention against IPR-infringing goods.
