Brief description of the
notified legal text
The Geographical
Indications Registration Regulations 2024 will replace the Geographical
Indications (Wine and Spirits) Registration Regulations 2017. The Regulations
are made under the Geographical Indications Registration Act 2006. Additions
to the 2024 Regulations:
a) provide a procedure for interested
persons to oppose a request from the EU to either protect a new geographical indication (GI) or amend
an existing GI protected under the NZ-EU Free Trade Agreement;
b) set out the amount of the fee that a
person must pay upon receipt of an infringement notice (for failure to comply with a notice of
direction requiring a person to stop misusing a registered GI);
c) set out the maximum fine a court may
impose for a person who fails to comply with an infringement notice; and
d) prescribe the form for an infringement
notice and reminder notice.
