Description of content: Dinotefuran is not an approved active substance in Great Britain (GB). An application was received by the Health and Safety Executive to set new MRLs for various commodities. Following assessment, new MRLs have been introduced to set Import Tolerances.

The residue levels arising in food and feed from the MRLs for tomatoes, aubergines/ eggplants, okra/ lady's fingers, gherkins, courgettes, other cucurbits with edible peel and tea result in UK consumer exposures below the toxicological reference values and therefore harmful effects on human health are not expected.

The MRL (0.3 mg/kg) for tomatoes will apply to all varieties listed in Part 1 of the GB MRL Statutory Register, except gojiberries/wolfberries, for which a specific MRL of 0.6 mg/kg is proposed to be adopted.

For peaches (the GB MRL also applies to nectarine), grapes and celeries following a review of all the available evidence, the UK's appropriate level of protection has not been met for the current GB MRLs and it is proposed to lower the MRLs to 0.01* mg/kg.

For a number of commodities, no specific MRLs have been established in the GB MRL Statutory Register. Therefore, the default LOQ MRL of 0.01* mg/kg currently applies. Specific MRLs at 0.01*mg/kg – 0.05* mg/kg are proposed to be included in the GB MRL Statutory Register for these commodities. Details of these can be found in the notified document.

This measure retains the previous MRLs for all other commodities.

The CXLs for eggs, poultry meat and poultry edible offals of, are 0.02* mg/kg based on a residue definition of the sum of dinotefuran and UF, expressed as dinotefuran. The GB residue definition is dinotefuran only and the GB MRLs proposed for these commodities is therefore 0.01* mg/kg; this is equivalent to the CXL.

The CXLs for a number of commodities have not been recommended for adoption. The review of the available evidence concluded these CXLs do not satisfy the UK's appropriate level of protection. GB MRLs have been recommended for specific crops within these commodity groups. The draft Reasoned Opinion outlines the detailed assessment.

As harm to human health cannot be excluded for the current MRLs for peaches, grapes and celeries, it is proposed these MRLs are lowered. All the MRLs (lowered, retained and raised) will come into force six months after the date of publication and adoption.
