and Full Notification Pursuant to Article XVII:4(a)
of the GATT 1994 and Paragraph 1 of the Understanding
on the Interpretation of Article XVII

The
following communication, dated 14 March 2024 and received on 19 March 2024, is
being circulated at the request of the delegation of Uruguay.

I._ ENUMERATION OF STATE TRADING ENTERPRISES
The
only state enterprise covered by the provisions of Article XVII of the GATT
1994, in accordance with paragraph 1 of the Understanding on the Interpretation
of Article XVII, is the Administración Nacional de Combustibles, Alcohol y
Portland (ANCAP).
ANCAP
has a monopoly on the importation and refining of crude petroleum and its
by-products, and also conducts other activities.
II._ REASON AND PURPOSE FOR ESTABLISHING AND
MAINTAINING THE STATE TRADING ENTERPRISE
The
monopoly on petroleum and fuels derived from petroleum was established because
they are deemed to be strategic products.
The
monopoly was created under the law setting up ANCAP (National Law No. 8764 of
15 October 1931).
III._ DESCRIPTION OF THE FUNCTIONING OF THE STATE
TRADING ENTERPRISE
ANCAP
is a state trading and industrial enterprise; its legal status is that of an
autonomous body subject to the rules of public law, rather than private
commercial law.
The
enterprise's Board of Directors, comprising five members, is appointed by the
Executive with parliamentary approval.
Since
1 July 2021, the Executive has approved the selling price of the various fuels
produced by ANCAP, with delivery at each of its distribution plants, subject to
a mandatory report by the Energy and Water Services Regulatory Authority
(URSEA) and ANCAP.
Imports
or exports by third parties of products over which ANCAP has a monopoly are not
permitted.
The import volume of crude petroleum and its by-products is
determined by domestic demand. The export volume of petroleum by-products
depends on the competitiveness of the enterprise and the stocks available.
On occasion, long-term contracts have been used for crude petroleum
supplies.
