The following communication, dated and received on 24 November 2025, is being circulated at the request of the delegation of the European Union.

On 18 November 2025, the European Union imposed a safeguard measure on certain ferro-alloying elements. Commission Implementing Regulation (EU) 2025/2351 was published in the Official Journal of the European Union and is available at: http://data.europa.eu/eli/reg_impl/2025/2351/oj

In accordance with the international obligations of the European Union, the measure must not apply to any product originating in a developing-country WTO Member or Algeria, provided that the share of imports of that product into the Union does not exceed 3%, and that developing-country WTO Members with an import share below 3% do not, collectively, account for more than 9% of total Union imports of the product concerned.

Unless expressly listed among the product types originating in developing countries to which the definitive measures apply (see under "Other Information": List of product types originating in developing countries to which the definitive measures apply), it has been established that imports of the product concerned originating in developing-country WTO Members and Algeria satisfy the conditions required to benefit from the above-mentioned derogation.
