The following communication, dated and received on 12 August 2024, is being circulated at the request of the delegation of the United States.

Pursuant to Article 12.1(b) of the WTO Agreement on Safeguards (Safeguards Agreement), the United States is supplementing its 11 July 2024 notification with additional information regarding the process to be followed by the Office of the United States Trade Representative (USTR) whereby domestic producers, importers, exporters, and other interested parties may submit their views and evidence on the appropriateness of the recommended safeguard measure and whether it would be in the public interest.

 

As notified in _G/SG/N/8/USA/11 (dated 12 July 2024), on July 9, 2024, the U.S. International Trade Commission (Commission) determined that imports of fine denier polyester staple fiber are being imported in such increased quantities as to be a substantial cause of serious injury to the domestic industry.

 

The Commission is now considering the appropriate remedy to recommend to the President, and will forward its injury findings and remedy recommendations to the President by August 26, 2024. USTR will commence a process whereby domestic producers, importers, exporters, and other interested parties may submit their views and evidence on the appropriateness of the recommended safeguard measure and whether it would be in the public interest. The relevant dates are as follows:

 

·_        Deadline for submission of written comments and request to appear at the public hearing: 9 September 2024

 

·_        Deadline for submission of written responses to the initial round of comments: 16 September 2024

 

·_        Public hearing: 30 September 2024
