Guidance Note on the Implementation of

Article 9.1.3 of the Agreement on Trade in Civil Aircraft

At its meeting of 11 November 2020, the Committee agreed to adopt the following guidance note.

In furtherance of the mandate given to it by the Agreement on Trade in Civil Aircraft ("Agreement") and by the Signatories, and to strengthen transparency and predictability, the Committee on Trade in Civil Aircraft ("Committee") hereby agrees to the following guidance note on the implementation of Article 9.1.3 of the Agreement.

 

1.     In accordance with Article 9.1.3 of the Agreement, any government which is a Member of the World Trade Organization ("WTO") may accede to this Agreement on terms to be agreed between that government and the Signatories of the Agreement.

 

2.     To this effect, a Member interested in accession shall communicate its interest to the Director-General of the WTO and, through him or her, to the Committee.

 

3.     The Member interested in accession shall (i) submit to the Committee information which the Signatories require, including how it will comply as of the date of accession with the obligations of the Agreement, and (ii) hold consultations with the Signatories, through the Committee, on the terms for its accession to the Agreement.

 

4.     A Member shall be deemed to have completed the process described in paragraph 3 if the Signatories agree that the Member provided the necessary information and completed all necessary consultations as part of its accession process to the WTO.

 

5.     Upon a decision by the Committee agreeing to the terms of accession, the applicant government shall take all necessary steps to comply with the terms of its accession and, with the consent of the Committee, the applicant government can deposit with the Director-General of the WTO an instrument of accession, which states the terms so agreed.
