United States - Anti-Dumping and Countervailing Duties on Ripe Olives from Spain - Recourse to article 22.7 of the DSU by the European Union

UNITED STATES – ANTI-DUMPING AND COUNTERVAILING DUTIES ON
RIPE OLIVES FROM SPAIN

RECOURSE TO ARTICLE 22.7 OF THE DSU BY THE EUROPEAN UNION

The following communication, dated 13 November 2025, from the delegation of the European Union to the Chairperson of the Dispute Settlement Body, is circulated pursuant to Article 22.7 of the DSU.

Further to the EU request of 14 November 2025[1] and in light of the decision of the Arbitrator in United States - Anti-Dumping and Countervailing Duties on Ripe Olives from Spain - Recourse to article 22.6 of the DSU by the United States[2], the European Union requests, pursuant to Article 22.7 of the DSU, authorization from the DSB to suspend concessions or other obligations with respect to the goods sector under the agreements listed in Annex 1A of the WTO Agreement, taken as a whole.

Specifically, consistent with the decision of the Arbitrator, the European Union requests authorization from the DSB:

·_        in relation to the application of Section 771B in the CVD investigation on ripe olives from Spain, to suspend concessions or other obligations at a level not exceeding USD 13.64 million per annum. This level of suspension of concessions or other obligations, (i) would need to be revised following modifications of the CVD rates on ripe olives from Spain taking place after 29 October 2025, and (ii) may be adjusted for inflation in 2024 and on an annual basis thereafter, in accordance, respectively, with sections 6.4 and 6.5 of the Decision of the Arbitrator; and

·_        in relation to any future application of Section 771B, to suspend concessions or other obligations at a level not to exceed an annual amount to be determined by applying the methodology described in section 7 of the Decision of the Arbitrator.

The list of US goods concerned will be established in due course.
