PERU – ADDITIONAL
DUTY ON IMPORTS
OF CERTAIN AGRICULTURAL PRODUCTS
Notification of a Mutually Agreed Solution
The following communication,
dated 23 April 2025, from the delegation of Peru and the delegation
of Guatemala to the Chairperson of the Dispute Settlement Body, is circulated
pursuant to Article 3.6 of the DSU.

Pursuant
to Article 3.6 of the Understanding on Rules and Procedures Governing the
Settlement of Disputes (DSU), the Governments of Peru and Guatemala hereby
notify the Dispute Settlement Body (DSB) that they have reached a mutually
agreed solution in the dispute DS457: Peru -
Additional Duty on Imports of Certain Agricultural Products, which
gave rise to recommendations and rulings of the DSB.
The
Government of Guatemala hereby acknowledges that the Government of Peru has
adopted the necessary measures to comply with the recommendations and rulings
of the DSB in this dispute. The DSB was informed of those measures in document
WT/DS457/17, in full conformity with the commitments of the Government of Peru under
the multilateral trading system.
In
the light of the above, the Governments of Peru and Guatemala have formally
agreed to terminate the dispute settlement proceedings in DS457. Therefore, the
Government of Guatemala withdraws the matter irrevocably from further
examination under the provisions of the DSU.
On
this basis, the Government of Guatemala will neither request initiation of
procedures pursuant to Article 21.5 of the DSU, nor request suspension of
concessions or other obligations pursuant to Article 22.6 of the DSU. The
Governments of Peru and Guatemala therefore terminate the understanding
regarding procedures under Articles 21 and 22 of the DSU which was communicated
to the DSB in document WT/DS457/18.
The
Governments of Peru and Guatemala agree that no action will be taken that has
the direct or indirect purpose or effect of undermining or offsetting the
object and purpose of this notification.
Accordingly,
the Governments of Peru and Guatemala jointly request that this notification be
circulated to the relevant Councils and Committee as well as to the DSB.
