Indonesia – importation of horticultural
products,
animals and animal products
Status Report regarding implementation of
the dsb recommendations and rulings
by Indonesia
Addendum
The following communication, dated 15 July
2024, from the delegation of Indonesia to the Chairperson of the Dispute
Settlement Body, is circulated pursuant to Article 21.6 of the DSU.
_______________
Indonesia provides the status report on the
implementation of rulings and recommendations of the DSB in the disputes
DS477/DS478 in accordance with Article 21.6 of the DSU.
Referring to measure 18 on self-sufficiency,
Indonesia submits that it has made significant adjustment to the relevant
provision by removing the disputed measure through the enactment of Law No.
6/2023, in lieu of Law No. 2/2022 concerning Job Creation.
Further, in order to implement DSB rulings
and recommendations on measure 1-17, Indonesia has amended a number of Minister
of Agriculture and Minister of Trade Regulations to address any issues related
to the importation regimes in horticultural products, animals, and animal
products.
Indonesia believes that those amendments have
also removed the disputed measures, namely harvest period restrictions, import
realization requirements, six-month harvest period requirements, reference
price, and domestic purchasing requirement.
Indonesia's continuous efforts to comply with
the DSB's rulings and recommendations demonstrates its willingness and
commitment to eliminate any trade barriers and to establish a non-restrictive
and transparent import regime.
Indonesia is ready to engage with New Zealand
and the United States with a view to reach positive solutions to the disputes.
