A summary of the notification in one of the WTO official languages

Import of tobacco raw materials, cigarette tissue and filters intended for industrial cigarette production can be carried out only by holders of a valid licence for the production of tobacco products.

The Requirements, approved by Order of the Ministry of Economy, Environment and Agriculture of Ukraine No 275 of 19 August 2025, set out the provisions for the full technological cycle of tobacco product manufacturing and apply exclusively to the production of cigarettes (HS codes 2402 20 90 10 and 2402 20 90 20 under UKT ZED). They are mandatory for all business entities engaged in economic activities related to the production of tobacco products.

The Requirements for the full technological cycle of tobacco products manufacturing provide that business entities must have ownership rights or rights of possession and/or use of real estate/premises and technological and other equipment, as well as the relevant technological processes necessary to process raw materials, with possible use of semi-finished products, ingredients, components, etc., into finished products according to the technological scheme defined by the business entity, indicating the stages of production. Such premises and equipment shall be used solely for manufacturing purposes by a single business entity, and their use for other purposes is prohibited. Business entities must also have a laboratory, either owned or engaged on a contractual basis.

The full technological cycle of tobacco product manufacturing includes:

·_        specially equipped premises for: preparation or processing of tobacco and tobacco raw materials; storage of tobacco raw materials; industrial production of tobacco products; storage of tobacco products. If the storage facilities for tobacco raw materials or tobacco products are located at a different address than the manufacturing facility, the business entity shall register such facilities in the Unified Register of Storage Facilities;

·_        regulatory and technological documentation for tobacco product manufacturing;

·_        equipment for the preparation or processing of tobacco and tobacco raw materials, and for the industrial production of tobacco products, in accordance with the technological scheme defined by the business entity, with production stages clearly indicated. Such equipment must be put into operation, and information on it shall be recorded in the Unified Register of Equipment;

·_        a laboratory (own or engaged under contract).

Business entities engaged in the production of tobacco products are required to undergo mandatory certification verifying compliance with the full technological production cycle. Licences for the production of tobacco products shall be granted only after this certification has been completed.
