Description
of content: The European Regulation
(EC) No 2023/915 of the European Parliament and of the Council of 25 April
2023 on maximum levels for certain contaminants in food was adopted in Israel
as part of Amendment No. 10 to the Public Health Protection (Food) Law, 5776
- 2015 (notified in G/TBT/N/ISR/1332/Rev.1), and appears in item 1 of the
Second Annex A to the Law with a few deviations as detailed in columns A and
C, in addition to the exceptions as stated in Section 3A(a1) to (a5) of the
Law.
This
regulation replaced the Commission Regulation (EC) No 1881/2006 setting
maximum levels for certain contaminants in foodstuffs of 19 December, 2006,
which was adopted within the framework of the Economic Plan Law (Legislative
Amendments for the Implementation of Economic Policy for the Budget Years
2021 and 2022), 5782-2021, through an indirect amendment to the Food Law
(Amendment No. 3), and was applied in Israel from 1 January, 2023.
It is now
proposed to apply the change to the adopted Regulation (EC) 2023/915 in full,
as implemented in the European Union by 1 December 2025. The main change
introduced by this proposed amendment is the addition of maximum permissible
levels of inorganic arsenic in fish and seafood, as implemented in Commission Regulation (EU) 2025/1891 of 17 September 2025,
amending Regulation (EU) 2023/915, as regards maximum levels of inorganic
arsenic in fish and other seafood.
