OF THE AGREEMENT ON IMPORT LICENSING PROCEDURES[1]

 

 

Article 7.1 of the Agreement on Import Licensing Procedures provides that "the Committee shall review as necessary, but at least once every two years, the implementation and operation of this Agreement, taking into account the objectives thereof, and the rights and obligations contained therein".

 

The main objectives of the Agreement are those listed in the preamble of the Agreement.

 

The information contained in this document covers the period from 30 October 2012 to 10 October 2014.

1.2  Summary of the main developments in the work of the Committee during the period covered

During the reporting period, the Committee held its thirty-seventh, thirty-eighth, thirty-ninth and fortieth meetings, on 22 April and 4 October 2013, and 15 April and 20 October 2014. The minutes of these meetings are contained in documents G/LIC/M/37-40, respectively.

 

During the period covered, the Committee: (i) received 44 notifications of legislation and/or publications submitted by 27 Members, 34 notifications relating to the institution of new import licensing procedures or changes in these procedures submitted by 15 Members; and 96 Replies to the Questionnaire on Import Licensing Procedures submitted by 61 Members. The list of notifications submitted by Members during the reporting period is contained in Annex I; (ii) discussed specific trade concerns raised by Members through written questions and replies; (iii) discussed the matter of compliance with notification obligations and how the issue of transparency could be improved; (iv) adopted its annual reports for 2013 and 2014 to the Council for Trade in Goods in accordance with Article 7.4 of the Agreement (G/L/1048 and [G/L/…]); (v) carried out the Tenth Biennial Review of the Implementation and Operation of the Agreement under Article 7.1 on the basis of a report prepared by the Secretariat (G/LIC/W/44).

 

1.2.1  Review of notifications

Reviewing Members' notifications under various provisions of the Agreement has been one of the key elements of the Committee's work. In terms of number of notifications received, Members' compliance with notification obligations remains stable when compared with the last review period (30.10.2010–29.10.2012). See Chart 1.

During this review period, three newly acceded members (Lao PDR, Tajikistan and Samoa) have submitted their first notifications[4] under this Agreement. However, improving the overall level of compliance with notification obligation is a key issue that has to be addressed in the Committee.  It is worth noting that there remain 16 Members who have not submitted any notification under the Agreement since joining the WTO (See Table 1). As emphasized by the Chairperson repeatedly at each formal meeting, Members that have not yet submitted the required notifications are urged to do so without delay. Members who have technical problems in preparing the notifications are requested to seek assistance from the Secretariat in order for them to comply with the requirements.

In addition to the above-mentioned Members, there are 12 Members who have not yet submitted a notification under Article 1.4(a) and or 8.2(b) concerning Members' laws and regulations, as well as the sources of information (See Table 2). However, the Secretariat would like to point out that almost all these Members have at some point submitted responses to the Questionnaire under Article 7.3, which partially covers the information required under Article 1.4(a)/8.2(b). This establishes a good basis for them to complete N/1 notifications in the near future. This is the case for Rwanda, for instance, which does not apply any import licensing procedure and has no laws or regulations relevant to this Agreement, as indicated in its notification (G/LIC/N/3/RWA/2). To fulfil its notification obligation under Article 1.4(a) and/or 8.2(b), Rwanda simply needs to notify the fact again under the N/1 notification. The Secretariat stands ready to provide technical assistance to these Members.

Regarding the notification under Article 7.3, and as the Chairperson noted at the 15 April 2014 Committee meeting, the overall compliance of this notification obligation has not been encouraging. In addition to the 16 Members listed in Table 1, the following 9 Members have not yet submitted any notification under Article 7.3: Angola, Benin, El Salvador, Gabon, Niger, Pakistan, Papua New Guinea, Samoa, and Swaziland.

 

The first problem that needs to be addressed is the low level of compliance. Although the Agreement requires all Members to provide replies to the Questionnaire on an annual basis, the total number of responses notified each year is much less than the membership of the WTO. In 2013, 48 N/3 notifications from 43 Members were received and reviewed by the Committee. In 2014, 45 N/3 notifications from 39 Members were reviewed.

 

The second issue is that the deadline of 30 September each year has not been fully respected. In 2013, only 30 Members notified before the deadline, and in 2014, 33 Members did so. The late arrival of the notifications leads to a further delay in the review exercise in the Committee, i.e. N/3 notifications submitted after the issuance of the October meeting airgram will have to be reviewed at the April Committee meeting of the following year.

 

The third challenge the Secretariat has encountered is the lack of clarity on the YEAR to which the N/3 notifications referred. Some Members have indicated the "year" of each N/3 notification at the beginning of the document. However, other Members have not done so. The situation is further complicated in cases where one Member which had not regularly notified under Article 7.3 chooses to submit two N/3 notifications in the same year (one at the beginning of the year, and one by the end of the year).

 

Of course, there are other technical issues to be addressed in this regard and the Secretariat is ready to work with Members to identify problems and explore possible solutions.

 

1.2.2  Discussion and exchanges on specific trade concerns

One of the main objectives of the Committee is to afford Members the opportunity to consult on any matters relating to the operation of this Agreement and to bring transparency to the administrative procedures and practices used in international trade.

 

Following the Rules of Procedures of this Agreement[5], a total of 32 documents containing written questions over import licensing systems maintained by other Members, and 21 documents containing replies, were circulated in document G/LIC/Q/- series during the review period. These questions were addressed to the following 22 Members: Argentina, Australia, Bangladesh, Brazil, Cambodia, Colombia, Ecuador, India, Indonesia, Malaysia, Mongolia, Russian Federation, Saint Lucia, Thailand, Turkey, Ukraine and Viet Nam. The exchanges among Members based on written questions and replies have provided additional clarity regarding import licensing practices/legislations of the Members. (A list of written questions and replies submitted by Members during the review period is contained in Annex V).

 

1.2.3  Consultations on how to improve notifications under Article 7.3 of the Agreement

During the past two years, the Chairman of the Committee held several informal consultations focusing on the proposed new template for notification under Article 7.3 of the Agreement. The consultations showed that, even though there was general support from the membership to improve the compliance level of notifications under this Article, Members' views differed regarding how to achieve this objective and, in particular, whether the existing Questionnaire should be revised. Some Members believed that a revised template with a more standardized format and some new language would help Members when preparing their notifications and thereby improve compliance. However, other Members were concerned that the proposed new template may lead to oversimplification of the information provided, thus jeopardizing the quality of notifications. The consultations were suspended due to the Bali Ministerial meeting. Since then, despite some informal signals of continued interest, neither the Chairman nor the Secretariat has received any new proposal from any Member on this subject. In his report to the Committee on 15 April 2014, the Chairman concluded that it seemed difficult to move the discussion forward without concrete inputs from the Members[6]. No informal consultations have been held on this issue since then.

 

2  Statistics of notifications

2.1  Notifications of publications and/or legislations (Articles 1.4(a) and/or 8.2(b))

Article 1.4(a) requires Members to notify to the Committee the sources in which the information concerning import licensing procedures are published, and to make copies of these publications available to the Secretariat. Paragraph 2(b) of Article 8 provides that "each Member shall inform the Committee of any changes in its laws and regulations relevant to this Agreement and in the administration of such laws and regulations".

 

The Committee agreed that, in cases where the publications or legislation were not in a WTO official language, Members shall provide, together with such publications or legislation, a summary of the notification in one of the WTO languages. Other Members may ask for a full translation if they so wish, or seek any additional information on a bilateral basis. Any issues that cannot be solved on a bilateral basis may be brought to the attention of the Committee. It was also agreed that the first notification under Article 8.2(b) shall contain the full text of relevant laws and regulations in effect on the entry into force of the WTO Agreement for the Member concerned (G/LIC/M/2 and G/LIC/3).

 

With regard to the form of notification, pursuant to the informal discussions on transparency issues held by the Committee since 2009, the Chairman indicated at the Committee's formal meeting on 11 April 2011 that the notification form, as contained in document G/LIC/22, would be used by Members, on a voluntary basis, to fulfil notification obligations under Article 1.4(a) and/or Article 8.2(b).

 

During the period covered, the Committee reviewed 44 notifications of legislation and/or publications pursuant to Articles 1.4(a) and/or 8.2(b) of the Agreement from 27 Members[7], which have been circulated in G/LIC/N/1- series. (See Annex II).

 

2.2  Notifications of import licensing procedures (Article 5)

Article 5.1 of the Agreement requires Members which institute licensing procedures or changes in these procedures to notify the Committee of such within 60 days of publication. Pursuant to Article 5.2, the notifications shall include: the list of products subject to licensing procedures; contact point for information on eligibility; administrative body(ies) for submission of applications; date and name of publication where licensing procedures are published; indication of whether the licensing procedure is automatic or non‑automatic according to definitions contained in Articles 2 and 3; in the case of automatic licensing procedures, their administrative purpose; in the case of non‑automatic licensing procedures, indication of the measure being implemented through the licensing procedure; and expected duration of the licensing procedure if this can be estimated with some probability, and if not, reason why this information cannot be provided. Article 5.4 requires Members to notify the Committee of the publications in which the information required in Article 1.4 will be published.

 

In addition, pursuant to Article 5.5, any interested Member which considers that another Member has not notified the institution of a licensing procedure or changes therein in accordance with the provisions of Articles 5.1-5.3 may bring the matter to the attention of such other Member. If notification is not made promptly thereafter, such Member may itself notify the licensing procedure or changes therein, including all relevant and available information.

 

Regarding the form of notification, pursuant to the informal discussions on transparency issues held by the Committee) since 2009, the Chair indicated at the Committee's formal meeting on 11 April 2011 that the notification forms, as contained in document G/LIC/22, would be used by Members, on a voluntary basis, to fulfil notification obligations under Article 5.1-5.4. Since them, a growing number of Members have chosen to use this form to notify.

 

During the period covered, the Committee considered 34 notifications submitted by 15 Members on the institution of import licensing procedures or changes in these procedures pursuant to paragraphs 1-4 of Article 5 which have been circulated in the G/LIC/N/2/- series (See Annex III). So far, there has been no notification submitted under Article 5.5.

 

2.3  Members' replies to annual questionnaire (Article 7.3)

Pursuant to Article 7.3 of the Agreement, Members undertake to complete the Annual Questionnaire on Import Licensing Procedures[8] promptly and in full. At its meeting in October 1995, the Committee established a deadline of 30 September each year to submit these notifications (see documents G/LIC/M/2 and G/LIC/3).

 

During the review period, the Committee considered 96 notifications submitted by 61 Members concerning the replies to the Questionnaire pursuant to Article 7.3 of the Agreement and, circulated in the G/LIC/N/3/- series (see Annex IV). It is worth noting that Lao, PDR and Tajikistan, two newly acceded Members, submitted their first notifications under Article 7.3 in 2013.

 

3  consultation and dispute settlement

During the reporting period, Panels DS438, DS444, and DS445 were established on "Argentina ‑Measures Affecting the Importation of Goods", where Articles 1.2; 1.3; 1.4; 1.5; 1.6; 1.7; 2.2; 3.2; 3.3; 3.4; 3.5; 5.1; 5.2; 5.3 and 5.4 of the Agreement on Import Licensing Procedures had been cited. At its meeting on 28 January 2013, the DSB established a single panel pursuant to Article 9.1 of the DSU to examine the above‑mentioned disputes. On 22 August 2014, the panel report was circulated to Members. This case is now in the process of appeal.

 

In documents G/LIC/D 44-48, the United States and New Zealand respectively, made requests for consultation on " Indonesia – Importation of Horticultural products, animal and animal products", where Articles 1.2, 1.5, 1.6, 2.2, 3.2, 3.3, 3.5, 5.1, and 5.2 of the Agreement on Import Licensing Procedures had been cited. No panel has been established yet.

 

4  annual reports (2013 and 2014) to the council for trade in goods

In accordance with Article 7.4 of the Agreement, the Committee adopted, on the basis of the documents prepared by the Secretariat (G/LIC/W/42 and G/LIC/W/43), its annual reports to the Council for Trade in Goods. The reports for 2013 and 2014 as revised and adopted were circulated as documents G/L/1048 and [G/L/…], respectively.

 

5  Tenth biennial review on the implementation and operation of the agreement

Article 7.1 of the Agreement establishes that "the Committee shall review as necessary, but at least once every two years, the implementation and operation of this Agreement, taking into account the objectives thereof, and the rights and obligations contained therein."

 

Since the last Biennial Review, the Committee Chairs have called on Members to engage more actively in the discussion so as to make the Biennial Review more dynamic. At the 14 April 2014 Committee meeting, the Chairman (2013) stressed that proposals with specific ideas from the Membership were indispensable.[9] However, no proposal on this issue has been received from the membership up to 10 October 2014.

[5] At its meeting on 23 October 1996, the Committee reached the Understanding on Procedures for the Review of Notifications Submitted under the Agreement on Import Licensing Procedures, circulated in document G/LIC/4. This Understanding provides that Members' views, and requests for clarification, should be communicated, in writing, to the delegations concerned with copies for information to the Secretariat preferably 21 days, but at least ten working days, in advance of the meeting at which they would be raised. Replies to the questions should also be forwarded to the delegations having raised the questions, in writing, with copies for information to the Secretariat. The questions and replies thus received would be circulated by the Secretariat.
