Notification of a Mutually Agreed Solution

The following communication, dated 13 July 2023, from the delegation of India and the delegation of the United States to the Chairperson of the Dispute Settlement Body, is circulated pursuant to Article 3.6 of the DSU.

The United States and India write in regard to the dispute India — Certain Measures Relating to Solar Cells and Solar Modules (DS456). The United States and India are pleased to notify the DSB, in accordance with Article 3.6 of the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU), that the parties have reached a mutually agreed solution to the matter raised in this dispute.

In light of the foregoing, the United States hereby withdraws its December 19, 2017, request (WT/DS456/18) to the DSB pursuant to Article 22.2 of the DSU for authorization to suspend the application to India of tariff concessions or other obligations under the General Agreement on Tariffs and Trade 1994 (GATT 1994).

The United States having withdrawn its request under Article 22.2 of the DSU, India hereby withdraws its January 03, 2018, request (WT/DS456/19) pursuant to Article 22.6 of the DSU objecting to the level of suspension of concessions or other obligations under the GATT 1994 proposed by the United States.

India further withdraws its January 23, 2018, request (WT/DS456/20) for the establishment of a compliance panel under Article 21.5 of the DSU.

We ask you to circulate this notification to the DSB and the relevant Councils and Committees.
