CHINA - SAFEGUARD MEASURE REGARDING MEAT OF BOVINE ANIMALS

REQUEST FOR CONSULTATIONS UNDER ARTICLE 12.3
OF THE AGREEMENT ON SAFEGUARDS

The following communication, dated and received on 16 January 2026, is being circulated at the request of the delegation of Brazil.

On 19 December 2025, China submitted to the WTO Committee on Safeguards a notification pursuant to Article 12.1(b) of the Agreement on Safeguards, concerning the findings of serious injury or threat thereof caused by increased imports of meat of bovine animals and, pursuant to Article 9.1, concerning the non-application of the measure to developing countries (Regions) should a safeguard measure be imposed (_G/SG/N/8/CHN/3 - _G/SG/N/11/CHN/3). The notification, however, did not contain all the pertinent information, as set forth in Article 12.2.

On 31 December 2025, China submitted to the WTO Committee on Safeguards a notification pursuant to Article 12.1(c) of the Agreement on Safeguards, concerning the decision to impose safeguard measures against imported meat of bovine animals and, under Article 9, footnote 2 of the Agreement on Safeguards, the non-application of the measure to developing countries (Regions) (_G/SG/N/10/CHN/3 - _G/SG/N/11/CHN/3/Suppl.1). The notification was circulated on 5 January 2026.

As a Member having a substantial interest in the export of products concerned, Brazil requests consultations with China pursuant to Article 12.3 of the Agreement on Safeguards, with a view to, inter alia, reviewing the information provided under Article 12.2 and exchanging views on the measure.

Brazil proposes that the consultations mentioned above take place virtually on a mutually agreed date and time.

Brazil reserves all its rights under the Agreement Establishing the World Trade Organization and its Annexes, including the Agreement on Safeguards.
