ARTICLE 12.3 OF THE AGREEMENT ON SAFEGUARDS

The following communication, dated and received on 22 December 2025, is being circulated at the request of the delegation of Australia.

On 19 December 2025, the People's Republic of China submitted to the WTO Committee on Safeguards a notification pursuant to Article 12.1(b) of the Agreement on Safeguards, concerning a finding of serious injury or threat thereof to domestic industries producing bovine meat _G/SG/N/8/CHN/3_G/SG/N/11/CHN/3.

As a Member having a substantial interest in the export of products concerned, Australia hereby requests consultations with the People's Republic of China pursuant to Article 12.3 of the Agreement on Safeguards.

Australia would like to propose that consultations mentioned above take place virtually on any day between 22 December and 24 December 2025 or on a mutually convenient date and time.

In Australia's view, the Information Disclosure (issued on 19 December 2025) provides insufficient detail to be the basis for consultations under Article 12.3 of the Agreement on Safeguards.

As such, Australia reserves all its rights under the Marrakesh Agreement Establishing the World Trade Organization and its Annexes, including the Agreement on Safeguards.
