Committee on Safeguards - Communication from the United states requesting consultations with the People's Republic of China under article 12.3 of the Agreement on Safeguards

COMMUNICATION FROM THE UNITED STATES REQUESTING CONSULTATIONS
WITH THE PEOPLE'S REPUBLIC OF CHINA UNDER ARTICLE 12.3
OF THE AGREEMENT ON SAFEGUARDS

The following communication, dated and received on 22 December 2025, is being circulated at the request of the delegation of the United States.

With reference to the People's Republic of China's (PRC) notification to the World Trade Organization (WTO) of the determination by the Ministry of Commerce (MOFCOM) of serious injury caused by increased imports of beef (_G/SG/N/8/CHN/3_G/SG/N/11/CHN/3 (dated 19 December 2025)), the United States hereby requests consultations with the appropriate officials of the PRC pursuant to Article 12.3 of the Agreement on Safeguards. The United States is a WTO Member having a substantial interest in the export of the product concerned.

The goal of the consultations would be to exchange views and seek clarification regarding the measure and reaching an understanding on ways to achieve the objectives set out in Article 8.1 of the Agreement on Safeguards. The United States observes that MOFCOM's determination does not propose any particular safeguard remedy in light of its serious injury determination. Thus, the United States proposes that the consultations discuss both MOFCOM's serious injury determination and any potential safeguard remedy that the PRC is considering imposing in light of MOFCOM's determination. This request for consultations is made without prejudice to the United States' rights under the WTO Agreement, including the Agreement on Safeguards.

The United States looks forward to the PRC's response to facilitate setting a mutually convenient date and time for these consultations.
