5 DESCRIPTION OF THE MEASURE:
Law
No. 1223, the General Law on Convergent Telecommunications, is a public
order law, and its provisions are mandatory and non-waivable. Law No. 1223
repeals Law No. 200, the General Law on Telecommunications and Postal
Services of 1995 (and its Consolidated Text published in 2019), which regulated
the sector until the new Law came into force.
The purpose of
Law No. 1223 is to regulate, govern, plan, supervise, oversee and develop
the telecommunications sector; establish the rights and obligations of Users,
Operators and Providers under conditions of quality, equity, security, equality
and free competition; establish provisions for the administration, use and
exploitation of the Radio Electric Spectrum, orbit-spectrum resources, and
public numbering resources; and promote and encourage investment in the sector,
innovation, and the efficient use of telecommunications networks and services
within a convergent environment for the development of information and
communication technologies (ICTs).
