Brief description of the notified legal text
The
purpose of draft is to bring the laws in the field of intellectual property
in line with the Law of the Kyrgyz Republic «On the protection of traditional
knowledge».
In view of that there was a necessity to introduce amendments to the
Regulation on the Conditions and procedure for provision of mandatory license
for industrial property object and its use approved by the Decree of
Government of the Kyrgyz Republic dated December 24, 1998 No.862; the Rules
for registration of agreement on cession of title of document for the object
of industrial property, selection achievement, license agreement on the right
for their use, agreement on the pledging of exclusive right for object of
industrial property and agreement on transfer of technology», approved by the
decree of Government of the Kyrgyz Republic as of 9 July 2010, No. 118, the
Rules of preparation, submission and
consideration of application for registration and provision of the right for
using traditional knowledge and application for the right to use already
registered traditional knowledge, the Procedure of maintaining of the State
register of traditional knowledge of the Kyrgyz Republic, approved by the
decree of Government of the Kyrgyz Republic as of 29 February 2012, No. 154.
In particular, the draft stipulates for amendments enabling to
conclude an agreement on the use of traditional knowledge, provision of
mandatory license, and appropriate amendments resulting from the above-mentioned
provisions.
The draft also provides for amendments of editorial nature and
resulting from enforcement practices.
