Addendum

1  general

1.1.  This document updates the Annual Report (2015) of the Council for TRIPS, issued as document IP/C/71 on 29 October 2015. That Report included the work of the Council up to the point when its end-of-year meeting was suspended on 16 October. Subsequently, the Council resumed its end-of-year meeting to continue its work on the agenda item on "Non-Violation and Situation Complaints". The minutes of the end-of-year meeting will cover the reconvened meeting along with the proceedings from 15-16 October, and will be circulated in documents IP/C/M/80 and IP/C/M/80/Add.1.

2  non-violation and situation complaints

2.1.  At its reconvened meeting on 23 November, the Council agreed to recommend, pursuant to the Decision of the Ministerial Conference of 2 December 2013 (WT/L/906), that the Tenth Session of the Ministerial Conference decide as follows:

"We take note of the work done by the Council for Trade-Related Aspects of Intellectual Property Rights pursuant to our Decision of 7 December 2013 on "TRIPS Non-Violation and Situation Complaints" (WT/L/906), and direct it to continue its examination of the scope and modalities for complaints of the types provided for under subparagraphs 1(b) and 1(c) of Article XXIII of GATT 1994 and make recommendations to our next Session, which we have decided to hold in 2017. It is agreed that, in the meantime, Members will not initiate such complaints under the TRIPS Agreement."
