Starting 1 January 2025, manufacturers must follow restrictions on certain consumer products. For other consumer products, if they use intentionally added priority chemicals identified in the rule, they need to report this to the Washington State Department of Ecology. These reportable products must be reported to Ecology by 31 January 2025.

 

Description: The Safer Products Restrictions and Reporting Rule (Chapter 173-337 WAC), adopted in 2023, implements the Safer Products for Washington program. This rule applies to priority consumer products manufactured, distributed, sold, or offered for sale within, or into, the state of Washington that contain a priority chemical.

Starting 1 January 2025, manufacturers must follow restrictions on certain consumer products. For other consumer products, if they use intentionally added priority chemicals we identified in the rule, they need to report this to the Washington State Department of Ecology. These reportable products must be reported to Ecology by 31 January 2025.

Key Compliance Deadlines:

·_        Restrictions: Restrictions on certain intentionally added priority chemicals took effect on 1 January 2025. Note: If there is a restriction, you do not report.

·_        Initial Reporting: Manufacturers, distributors, and retailers required to report must submit their first notification through the High Priority Chemicals Data System (HPCDS) by 31 January 2025. Note: If there is a reporting requirement, the chemical is not restricted.

o_   First-time users need to create an HPCDS account before submitting information. Click '_Register' under the login button.

o_   See reporting requirements (WAC 173-337-060) for details about the information that must be included in annual reports.

·_        Ongoing Reporting: Products tracked beginning 1 January 2024, must be reported by 31 January 2025. Every year thereafter, manufacturers are required to report the previous year's products by 31 January of the following year.
