Indonesia – importation of horticultural
products,
animals and animal products
Status Report regarding implementation of
the dsb recommendations and rulings
by Indonesia
Addendum
The following communication, dated 5 December
2024, from the delegation of Indonesia to the Chairperson of the Dispute
Settlement Body, is circulated pursuant to Article 21.6 of the DSU.
_______________
Indonesia submits the status report pursuant
to Article 21.6 of the DSU.
Indonesia reaffirms the importance of
adhering to the rulings and recommendations of the Dispute Settlement Body
(DSB) in DS477/DS478 disputes and remains committed to implementing the
findings of the Panel and the Appellate Body.
As outlined in previous status reports, we
would like to reiterate that Indonesia has taken corrective actions with the
enactment of laws and regulations that resolved the measures at issues in these
disputes, by eliminating policies related to self-sufficiency, harvest period
restrictions, import realization requirements, six-month harvest period
obligations, reference prices, and domestic purchasing requirements.
Against this background, Indonesia is of the
view that its import policies are in line with the WTO provisions, while at the
same time maintaining a transparent trade system, including with the
implementation of commodity balance mechanism.
Furthermore, Indonesia is committed to engage
constructively in exploring and discussing these disputes with New Zealand and
the United States. We further believe that it is essential that this
longstanding dispute is addressed with clarity to achieve a mutually acceptable
solution.
