Indonesia – importation of horticultural
products,
animals and animal products
Status Report regarding implementation of
the dsb recommendations and rulings
by Indonesia
Addendum
The following communication, dated 12
September 2024, from the delegation of Indonesia to the Chairperson of
the Dispute Settlement Body, is circulated pursuant to Article 21.6 of the
DSU.
_______________
Indonesia
submits the status report regarding the implementation of rulings and
recommendations of the DSB in DS477/DS478 disputes, pursuant to Article 21.6 of
the DSU.
Indonesia
continues to reiterate that it has enacted Law No. 6/2023, in lieu of Law No.
2/2022 concerning Job Creation to eliminate measure 18 regarding
self-sufficiency.
Further
on measure 1-17, in order to implement the DSB rulings and recommendations,
Indonesia has amended several Minister of Agriculture and Minister of Trade
Regulations to address any issues related to the importation regimes in
horticultural products, animals, and animal products.
Indonesia
believes that those amendments have removed harvest period restrictions, import
realization requirements, six-month harvest period requirements, reference
price, and domestic purchasing requirement.
We
further highlight our efforts to adjust regulations, with the spirit to enhance
transparency and predictability in the importation regimes and to streamline
administrative processes.
Against
this backdrop, Indonesia believes that it has demonstrated its willingness in adhering
to the Appellate Body and the Panel's findings, ensuring that its trade policy
is in line with the WTO provisions.
Indonesia stands ready to work constructively with New Zealand and the
United States in order to find amicable solutions to these disputes.
