Addendum
The following communication, received on 13
May 2024, from the delegation of Indonesia to the Chairperson of the
Dispute Settlement Body, is circulated pursuant to Article 21.6 of the
DSU.

Indonesia
reiterates its commitment to implement the rulings and recommendations of the
DSB as well as to provide a status report on DS477/DS478 in accordance with
Article 21.6 of the DSU.
With
regard to self-sufficiency measure, Indonesia is of the view that the enactment
of Law No. 6/2023, which replaced Law No. 2/2022 concerning Job Creation
has eliminated inconsistent measure, as indicated in the Panel and Appellate
Body reports.
On
measure 1-17, Indonesia believes that it has taken significant and concrete
actions by removing disputed measures through the amendment of related Minister
of Agriculture and Minister of Trade Regulations concerning horticultural
products, animals, and animal products, such as harvest period restrictions,
import realization requirements, six-month harvest period requirements,
reference price, and domestic purchasing requirements.
Indonesia
takes note of the concerns raised by complainants at the previous DSB meetings
and emphasizes that the Commodity Balance mechanism aiming to facilitate trade
without imposing unnecessary barriers. Furthermore, Indonesia submits that the
National System on Commodity Balance ("SINAS-NK") serves as
assurances that the import approval is processed accordingly and in appropriate
manner.
Indonesia
is willing to work with New Zealand and the United States with a view to reach
a positive solution on these disputes.
