Indonesia – importation of horticultural
products,
animals and animal products
Status Report regarding implementation of
the dsb recommendations and rulings
by Indonesia
Addendum
The following communication, dated 7 March
2024, from the delegation of Indonesia to the Chairperson of the Dispute
Settlement Body, is circulated pursuant to Article 21.6 of the DSU.
_______________
Indonesia provides a status report in these
disputes in accordance with Article 21.6 of the DSU.
In
addressing the concerns raised by the complainant regarding Indonesia's
compliance, Indonesia would like to reaffirm that it has implemented Law No.
6/2023 on the Stipulation of the Government of Regulation in lieu of Law No.
2/2022 on Job Creation. This demonstrates our commitment to implementing the
recommendations and rulings of the DSB related to self-sufficiency measure.
Significant
adjustments have also been made to Indonesia's import policies concerning
Measures 1 - 17 by amending relevant Minister of Agriculture and
Minister of Trade Regulations. Indonesia submits that these adjustments removed
the disputed measures at issue, such as harvest periods restriction, import
realization requirements, six-month harvest requirement, reference price, and
domestic purchasing.
With
regards to concerns raised by complainants regarding commodity balance,
Indonesia remains confident that this mechanism serves as a tool to facilitate,
streamline and expedite trade flow without creating unnecessary burdens and
restrictive effects on trade.
Indonesia
is ready to engage and work in a constructive manner with New Zealand and the
United States with a view to achieve acceptable solution to these disputes.
