These regulations cover a range of manufactured products including mobile phones, lifts, industrial machinery, toys and household appliances.

Description of content: The United Kingdom has announced its intention to provide businesses with the flexibility to continue to place goods that meet current EU requirements, including the CE marking, on the market in Great Britain. This will apply to most manufactured products and this approach will cover 21 product regulations (see attached document).

The United Kingdom also intends to introduce a 'Fast-Track UKCA' measure, allowing manufacturers to use the UKCA marking to demonstrate compliance, in GB, with either UKCA product requirements or EU product requirements where they are recognised. Where products are covered by multiple regulations, a mixture of both UKCA and CE conformity assessment procedures can be used.

For the restriction of hazardous substances (RoHS) in electrical equipment regulation, we are taking a two-part approach. Where products meet the maximum concentration values set out in Annex II to the EU RoHS Directive (2011/65/EU), we will continue to recognise current EU regulations and CE marking. Where a product relies on an exemption, we will also continue to recognise current EU regulations and CE marking provided there is an equivalent exemption under the GB RoHS regulations.

This legislation applies to Great Britain (England, Scotland and Wales) and does not apply in Northern Ireland.

Objective and rationale, including the nature of urgent problems where applicable: Since 1 January 2021, the UK has continued to recognise CE marking alongside the UKCA (UK Conformity Assessed) regime for products placed on the GB market covered under relevant regulations. This approach has enabled businesses to use either product marking when placing goods on the GB market. However, EU recognition is due to end on 31 December 2024.

We are introducing these trade facilitating measures to ensure products can continue to circulate on the market in Great Britain (GB) safely, and in compliance with GB requirements, from 1 January 2025.

We are notifying and publishing these measures to address problems of public safety and national security, as per articles 2.10.1, 5.7.1 and 5.9 of the WTO TBT Agreement:

·_        Public safety – non-compliant but otherwise safe products may be prevented from being placed on the GB market from 1 January 2025 due to potential difficulties getting the UKCA marking resulting from unwanted costs for businesses; or there may be shortages of products where the UKCA marking requirements cannot be assessed.

·_        National security – many products covered by the UKCA regime are used in critical national infrastructure and key industries.
