Addendum

The following communication, dated 7 December 2023, from the delegation of Indonesia to the Chairperson of the Dispute Settlement Body, is circulated pursuant to Article 21.6 of the DSU.

Indonesia submits this report in accordance with Article 21.6 DSU.

Indonesia continues to reiterate its strong commitment to implement the recommendations and rulings of the DSB in these disputes, including with the emphasis on Measure 18 related to self‑sufficiency. In this regard, such implementation has been performed following the enactment of Law No. 6/2023 on the Stipulation of the Government Regulation in lieu of Law No. 2/2022 on Job Creation.

In relation to Measure 1-17, Indonesia made major necessary adjustments to its import policies following the amendments to the relevant regulations of the Minister of Agriculture and the Minister of Trade. Indonesia firmly believes that these amendments have resulted into the removal of measures at issue, including but not limited to restrictions on harvest periods, import realization requirements, six-month harvest requirement, reference price, and domestic purchase requirements.

While taking into account the interests expressed by the complainants on Indonesia's Commodity Balance mechanism, we are pleased to continue informing that the Commodity Balance would serve as a tool to facilitate, ease, and expedite trade activities through the utilization of an integrated national database system without imposing additional burdens or restrictive effects on trade.

Indonesia also wishes to emphasize its readiness to continue discussions with New Zealand and the United States with a view to reach solutions to these disputes.
