CERTAIN STEEL PRODUCTS
Status Report regarding implementation of the
dsb recommendations and rulings
by the European Union
The following communication, dated 16 January
2023, from the delegation of the European Union to the Chairperson of the
Dispute Settlement Body, is circulated pursuant to Article 21.6 of the
DSU.

The
European Union submits this report under Article 21.6 of the Understanding on
Rules and Procedures Governing the Settlement of Disputes ("DSU"), to
notify the Dispute Settlement Body ("DSB") of the achievement of
implementation, and to provide the DSB with a status report in writing of its
progress in the implementation of the recommendations or rulings.
On
31 May 2022, the DSB adopted its recommendations and rulings in the dispute European Union – Safeguard Measures on Certain Steel
Products (DS595). At the DSB meeting of 30 June 2022, the European
Union informed the DSB that, pursuant to Article 21.3 of the DSU, it intended
to implement the recommendations and rulings of the DSB in this dispute in a
manner that respects its WTO obligations, but that it needed a reasonable
period of time to do so.
On 5
August 2022, Türkiye and the European Union informed the DSB that they had
agreed, pursuant to Article 21.3(b) of the DSU, that the reasonable period of
time for the European Union to comply with the DSB's recommendations and
rulings would be 7 months and 16 days and would expire on 16 January 2023.
The
European Union hereby informs the Dispute Settlement Body that it has, on 13
January 2023 with entry into force on 14 January 2023, adopted the measure
necessary to comply with the recommendations and rulings before the expiry of
the reasonable period of time agreed with Türkiye. On 13 January 2023, the
European Union adopted Commission Implementing Regulation (EU) 2023/104
amending Commission Implementing Regulation (EU) 2019/159 imposing a definitive
safeguard measure on imports of certain steel products following a report
adopted by the World Trade Organization’s Dispute Settlement Body, published in
the Official Journal of the European Union on 13 January 2023 (OJ L 12,
13.01.2023 p. 7-27),[1]
entering into force on 14 January 2023.
The
adoption and entry into force of this Regulation achieves the European Union’s
full implementation of the DSB recommendations and rulings in this dispute. A
copy of this Regulation is attached to this status report. The European Union proposes that this issue
of implementation of recommendations or rulings be placed on the agenda of the
next DSB meeting.
