Addendum
The following communication, dated 16 January
2023, from the delegation of Indonesia to the Chairperson of the Dispute
Settlement Body, is circulated pursuant to Article 21.6 of the DSU.

Indonesia submits this report following Article
21.6 of the Understanding of Dispute Settlement Rules and Procedures (DSU).
Indonesia took note of New Zealand's and the
United States’ concerns in previous DSB sessions and is fully committed to
implementing the recommendations and decisions of the DSB in these disputes.
Indonesia has issued the Government Regulation
in Lieu of Law Number 2/2022 to revoke and replace Law No. 11/2020 which
entered into force on 30 December 2022. With this enforcement, measure 18
concerning self-sufficiency in relevant laws that were found to be inconsistent
with WTO regulations remains completely abolished.
Regarding measures 1–17, Indonesia has also
made significant and substantial changes to the relevant Minister Regulations
and removed the disputed provisions related to harvest period restriction,
import realization requirements, six-months harvest requirement, reference
price, and domestic purchase requirement.
Indonesia reiterates that Commodity Balance is
merely a procedural framework for transparently delivering comprehensive,
detailed, and accurate data to streamline the permit procedure. An integrated
national database system will support the Commodity Balance to provide business
certainty without limiting effect on trade flow.
Finally, Indonesia commits to working with New
Zealand and the United States to address these concerns.
