Description: The Federal Council adopted the final version of the Energy Efficiency Ordinance, previously notified as G/TBT/N/CHE/268. Stakeholders' and other Members' comments have been considered in the final phase of the legislative process.

The amendments to the already notified draft Energy Efficiency Ordinance are as follows:

The initially proposed minimum energy performance standards (MEPS) for the following product categories have been completely lifted:

·        Household refrigerators

·        Household dishwashers

·        professional refrigerated storage cabinets

The transitional period has been changed. The final transitional periods for the MEPS are as follows:

·        The novel MEPS shall apply from the 1st January 2024

·        Appliances which have been placed on the Swiss market before the 1st January 2024 and which do not fulfil the novel MEPS can remain available on the market until the 31st December 2024.

The MEPS for the following product categories have been changed:

·        Household Tumble dries:

o   As of 1 January 2024, mains-operated domestic tumble dryers that have a drying performance of less than or equal to 4 kg per hour (standard full load cotton program) may only be placed or made available on the market if their EEI determined in accordance with Annex II, ch. 1, of Regulation (EU) No. 932/2012 is less than 24.

o   As of 1 January 2024, mains-operated domestic tumble dryers that have a drying performance of more than 4 kg per hour (standard full load cotton program) may only be placed or made available on the market if their EEI determined in accordance with Annex II, No. 1 of Regulation (EU) No. 932/2012 is less than 32.

·        Local space heaters

o   As of 1 January 2024, electric local spacer heaters, with the exception of commercial decentralized heaters, may only be placed or made available on the market if their seasonal energy efficiency for space heating determined in accordance with Annex III of Regulation (EU) 2015/1188 is not less than 39%.

·        Professional cooking appliances:

o   As of 1 January 2024, professional mains-operated hobs may only be placed or made available on the market if they are induction hobs or infrared hobs equipped with a pan detector that cannot be permanently deactivated.

o   From 1 January 2024, professional mains-operated deep fryers may only be placed or made available on the market if their tank has a thermal insulation with an R-value of at least 0.12 square metre Kelvin per watt. Any cold zones intended to extend the service life of the oil do not have to be insulated.

The following exemptions from the MEPS have been adopted:

·        The novel MEPS for electric water heaters do not apply to built-in water heaters whose dimensions fall under the Swiss measurement system (SMS standard)

·        The novel MEPS for electric local space heaters do not apply to pew heaters.

·        The novel MEPS for electric space and combined heaters do not apply to equipment for underground protective structures or underground military structures.
