Description of content: The
draft Law aims to establish the procedures for placing of plant protection
products and agrochemicals on the market in accordance with the EU
regulations in force. Its purpose is to define the terminology and basic
concepts on the approval of active substances, antidotes and synergists
contained in the preparative forms of plant protection products, to define
unacceptable coformulants that cannot be contained in plant protection
products, to harmonize the procedures for placing on the market of
agrochemicals and to determine the procedure for handling hazardous
substances.
The draft Order is developed to improve the state regulation in the
sphere of pesticides and agrochemicals taking into account the Regulation
(EC) No 1107/2009 of the European Parliament and of the Council of 21 October
2009 concerning the placing of plant protection products on the market and
repealing Council Directives 79/117/EEC and 91/414/EEC, Regulation (EU)
2019/1009 of the European Parliament and of the Council of 5 June 2019 laying
down rules on the making available on the market of EU fertilising products
and amending Regulations (EC) No 1069/2009 and (EC) No 1107/2009 and
repealing Regulation (EC) No 2003/2003.
It is established that all existing registrations of pesticides and
agrochemicals in accordance with the Law of Ukraine "On Pesticides and
Agrochemicals", which will be valid as of the date of entry into force
of this Law, shall remain valid until their completion without the need for
approval of the active substance.
The current Law of Ukraine "On Pesticides and
Agrochemicals" will become invalid from the date of entry into force of
this Law.
The draft Law is also notified in accordance with the provisions of
the Agreement on the Application of Sanitary and Phytosanitary Measures.
