Status Report regarding implementation of
the dsb recommendations and rulings
by Indonesia
Addendum
The following communication, dated 12
September 2022, from the delegation of Indonesia to the Chairperson of the
Dispute Settlement Body, is circulated pursuant to Article 21.6 of the
DSU.
_______________
Indonesia submits this report in pursuant to Article
21.6 of the Understanding on Rules and Procedures Governing the Settlement of
Disputes (DSU).
Indonesia takes note of New Zealand and the United
States' concerns in the previous meetings and fully commits to implement the
recommendations and rulings of the DSB in these disputes.
On measure 18 concerning self-sufficiency, as stated
in several DSB meetings, Indonesia reiterates that all Articles in the relevant
Laws that were found to be inconsistent with WTO rules have been removed
through the enactment of Law No. 11/2020 on Job Creation.
Regarding measures 1-17, Indonesia has complied with
the recommendations and rulings of the DSB through a series of significant
adjustments of the relevant Ministry of Agriculture and Ministry of Trade
Regulations. Indonesia has removed disputed measures, such as harvest period
restriction, import realization requirements, six-months harvest requirement,
reference price, and domestic purchase requirement.
In response to the United States' concern on commodity
balance, Indonesia continues to emphasize positive impacts of this policy which
enables us to streamline permit processing and to provide clarity on permit
timeframe by using integrated national database system that is conducted in a
transparent manner.
Indonesia always stands ready to engage with New
Zealand and the United States to resolve the issues in these disputes.
