Status Report regarding implementation of
the dsb recommendations and rulings
by Indonesia
Addendum
The following communication, dated 15 April
2021, from the delegation of Indonesia to the Chairperson of the Dispute
Settlement Body, is circulated pursuant to Article 21.6 of the DSU.

Indonesia submits this report pursuant to
Article 21.6 of the Understanding on Rules and Procedures Governing the
Settlement of Disputes (DSU).
Indonesia would like
to reiterate its commitment to implementing the recommendations and rulings of
the DSB in these disputes. This commitment has been reflected by numerous
adjustments in relevant laws and regulations, which are not only substantial
but also highly political.
As reported in
previous DSB meetings, Indonesia has enacted Law No.11/2020 on Job Creation,
which include adjustments to measure 18 by addressing all specific Articles in
the previous Laws which were found inconsistent with WTO obligations. These
Articles have now been amended and are no longer in place.
With regard to
measure 1-17, Indonesia would like to refer to its position in the previous DSB
Meetings that significant adjustments have been made through the amendments of
the relevant MoA and MoT Regulations. Those adjustments also include the removal of the disputed measures, inter
alia; harvest period
restriction, import realization requirements, six-months harvest requirement,
and reference price. Indonesia continues to note
concerns raised by New Zealand and the United States and reaffirms its commitment to implementing the
recommendations and rulings of the DSB in these disputes.
Indonesia will continue to engage with New
Zealand and the United States regarding matters related to the recommendations
and rulings of the DSB.
