United States – Anti-dumping and Countervailing Duties on Certain Products and the Use of Facts Available

Communication from the Republic of Korea

The following communication, dated 25 March 2021, was received from the delegation of Korea with the request that it be circulated to the Dispute Settlement Body (DSB).

The Republic of Korea has taken note of the United States' decision to appeal the Panel Report in DS539 United States – Anti-Dumping and Countervailing Duties on Certain Products and the Use of Facts Available, as notified in its letter of 19 March 2021.

Given that the Appellate Body is currently not functioning and in light of the fact that the United States did not file an appellant submission, Korea considers that all procedural deadlines in the Appellate Body's Working Procedures shall be deemed suspended until further notice. Korea reserves its full right to file its own appeal on issues of law and legal interpretation in the DS539 Panel Report and to respond to the United States' appeal and awaits the instructions of the Appellate Body in this respect.

Korea is providing a copy of this note directly to the United States.
