Treatment on Certain Goods
Request for the Establishment of a Panel
by Japan
The following communication, dated 19 March 2020,
from the delegation of Japan to the Chairperson of the Dispute Settlement Body,
is circulated pursuant to Article 6.2 of the DSU.

My authorities have
instructed me to request the establishment of a panel pursuant to Articles 4.7
and 6 of the Understanding on Rules and Procedures Governing the Settlement of
Disputes ("DSU"), and Article XXIII of the General Agreement on
Tariffs and Trade 1994 ("GATT 1994") with respect to the measures by
India imposing customs duties, in excess of the applicable bound rates, on certain
goods imported from Japan.
On 10 May 2019,
Japan requested consultations with India.[1]
The Government of Japan and the Government of India held consultations on 23
May 2019, with a view to reaching a mutually satisfactory solution.
Unfortunately, the consultations failed to settle the dispute.
The products set
out below fall within the scope of the relevant tariff lines for which India
has set the bound rate of 0%. However, India applies duties in excess of the
bound rate on these products.
