The following communication, dated 4 May 2018, from the Chair of the Appellate Body addressed to the Chair of the Dispute Settlement Body, is circulated to Members in accordance with Article 17.5 of the Understanding on Rules and Procedures Governing the Settlement of Disputes.

I refer to the Chair of the Appellate Body's letter of 21 December 2016, setting out the reasons why the Appellate Body would not be able to circulate its report in these proceedings within the timeframes provided for in Article 17.5 of the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU). We are now in a position to inform you that we will circulate the report no later than 15 May 2018.
