The following communication, dated 9 August 2016, from the Chair of the Appellate Body to the Chair of the Dispute Settlement Body, is being circulated to Members.

I refer to the letter from the Chair of the Appellate Body of 19 July 2016, setting out the reasons why the Appellate Body would not be able to circulate its report in these proceedings within the 90-day time-frame provided for in Article 17.5 of the DSU. We can now inform you that we expect to circulate the Appellate Body report in this appeal no later than 6 October 2016.
