United States – measures concerning the
importation, marketing and sale of tuna and tuna products
Communication from Canada
The following communication,
dated 11 April 2016, was received from the
delegation of Canada
with the request that it be circulated to the Dispute
Settlement Body (DSB).

At the regular DSB meeting held on 23 March
2016, as set out in document WT/DS381/29, Mexico sought recourse to Article
22.2 of the Understanding on Rules and Procedures Governing the Settlement of Disputes
("DSU") in the dispute United States – Measures
Concerning the Importation, Marketing and Sale of Tuna and Tuna Products
(DS381). Pursuant to DSU Article 22.6,
at the same DSB meeting, as set out in document WT/DS381/30, the United States
objected to the level of suspension of concessions or other obligations
proposed by Mexico and the matter was referred to arbitration.
If
these arbitral proceedings address any disagreement between the Parties
concerning compliance, Canada hereby reserves its third party rights.
We
request that you please circulate the attached letter to all Members.
