Agreement under Article 21.3(b) of the DSU

The following communication, dated 8 December 2014, from the delegation of China and the delegation of Japan to the Chairperson of the Dispute Settlement Body, is circulated in accordance with Article 21.3(b) of the DSU.

We wish to inform you that, pursuant to Article 21.3(b) of the Understanding on Rules and Procedures Governing the Settlement of Disputes ("DSU"), China and Japan have agreed that the reasonable period of time for China to implement the recommendations and rulings of the Dispute Settlement Body ("DSB") in the dispute China — Measures Related to the Exportation of Rare Earths, Tungsten and Molybdenum (WT/DS433) shall be 8 months and 3 days from the 29 August 2014 date of adoption of the DSB recommendations and rulings. Accordingly, the reasonable period of time expires on 2 May 2015.

We request that you circulate this notification to the Members of the DSB.
