Description of content: A
complete revision of the legal regulations related to the subject, with the
involvement of the affected authorities, the existing and future licence
holders, and relying on the current knowledge available in technical
development. In the course of this, the explanatory provisions about the
subject were defined, as well as the Nuclear Fire Protection Regulation, the
Radioactive Waste Deposit Fire Protection Regulation and the Organisational
Rules, as well as special rules regarding official checking. The draft
specifies the fire protection requirements of temporary dry storages of
burnt-out nuclear heating elements of nuclear power plants and research
reactors, and of the radioactive waste storage facilities used for the
temporary storage or the final deposit of radioactive waste.

Objective
and rationale, including the nature of urgent problems where applicable: In Hungary,
the special fire protection requirements related to atomic energy are
presently regulated by ÖTM (Minister of Local Authorities and Rural
Development) decree 19/2007. (VIII.29.) on specific fire protection rules for
use of atomic energy and on the enforcement of the rules by the authorities
(hereinafter: D). The completely revised version of the Ministry of Interior
decree on National Fire Protection Regulations (hereinafter NFPR) is under
finalisation, following the technical development and the adoption of EU
standards. The concept of the new NFPR breaks with the valid regulation.
Considering the fact that some parts of the D are based on the valid NFPR, in
order to establish coherence with the new regulations, it is necessary to
issue a new minister's decree. The new regulation is based on two basic
considerations. The draft defines the fire protection requirements in a way
that they do not make the operation of the existing nuclear power plant
impossible, but in the case of an extension, maximum security level could be
defined, based on the current knowledge available in technical development.
