Communication from Brazil

The following communication, dated 30 June 2014, from the delegation of Brazil to the delegation of Indonesia, the delegation of the European Union and to the Chairperson of the Dispute Settlement Body, is circulated in accordance with Article 4.11 of the DSU.

Pursuant to Article 4.11 of the DSU, I would like to inform you that Brazil considers it has a substantial trade interest in the following dispute: Indonesia – Recourse to article 22.2 of the DSU in the US – Clove cigarettes dispute (Complainant: European Union), DS481.

As you recall, Brazil was a Third Party in the US – Clove cigarettes dispute and has also requested to be a Third Party in the arbitration under Article 22.6. Additionally, Brazil has a systemic interest in the legal issues raised in this dispute, which will raise matters of procedural and textual interpretation of clear importance to WTO Members.

In light of the above, I have been instructed to express Brazil's desire to be joined in the consultations requested by the European Union in document WT/DS481/1.  I look forward to receiving Indonesia's positive reply to this request.
