Communication
from Australia
The following communication, dated 26 June 2014,
from the delegation of Australia to the delegation of Indonesia, the delegation
of the European Union and to the Chairperson of the Dispute Settlement Body, is
circulated in accordance with Article 4.11 of the DSU.

Pursuant to
Article 4.11 of the Understanding on Rules
and Procedures Governing the Settlement of Disputes (DSU), Australia
notifies the Government of the Republic of Indonesia that it desires to be
joined in Indonesia’s consultations with the European Union pursuant to the
communication entitled Indonesia – Recourse
to Article 22.2 of the DSU in the US - Clove Cigarettes dispute circulated
to WTO Members on 17 June 2014 (WT/DS481).
Australia
has a substantial interest in this matter as an active member of the WTO with
an interest in the clarification of Members’ rights and obligations under the
Dispute Settlement Understanding. This dispute involves an issue that is of fundamental systemic
importance to the entire WTO membership.
Mindful
of the rights and obligations of WTO Members under Article 4.11 of the DSU,
Australia looks forward to receiving your reply, and advice of the date and
venue of the consultations.
