Article 21.5 of the DSU stipulates that a
panel established under that provision shall circulate its report within 90
days after the date of referral of the matter to it.
Article
21.5 of the DSU further stipulates that when a panel considers that it cannot
provide its report within that timeframe, it shall inform the DSB in writing of
the reasons for the delay together with an estimate of the period within which
it will issue its report.
On
20 January 2006,
the DSB agreed to refer the dispute Chile
– Price Band System and Safeguard Measures
Relating to Certain Agricultural Product: Recourse to Article 21.5 of the DSU by Argentina (WT/DS207) to the original Panel, if possible. The parties agreed on the composition of the
Panel on 4 April 2006.
Due
to the time required for the translation of the submissions, the Panel will not
be able to issue its report within the 90-day period foreseen in Article 21.5
of the DSU.
The
Panel expects to complete its work by November 2006.
