Communication from the European Communities

 

 

            The following communication, dated 17 February 1999, from the Permanent Delegation of the European Commission to the Permanent Mission of the United States and to the Chairman of the Dispute Settlement Body, is circulated in accordance with Article 4.11 of the DSU.

            I refer to the request by the Government of Japan, dated 10 February 1999, to hold consultations with the Government of the United States  pursuant to Article 4 of the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU), Article XXII:1 of the General Agreement on Tariffs and Trade 1994 (GATT 1994) and Article 17.2 of the Agreement on Implementation of Article VI of GATT 1994 (Anti-Dumping Agreement) regarding the United States Anti-Dumping Act of 1916 (15 USC 72).

 

            As you know, the European Communities are also concerned about the consistency of the 1916 Act with a number of provisions of GATT 1994 and the Anti-Dumping Agreement, and have a substantial trading interest in the object of the present consultations.

 

            Therefore, on behalf of the European Communities, I request the United States of America to accept the European Communities joining the consultations between Japan and the United States of America concerning the 1916 Anti-Dumping Act, in accordance with Article 4.11 of the DSU.
